I spoke with Scott today. My impression...He seems to be handling things as well as can be expected. His troubles are only starting though. His Father has left him with quite a mess to clean up...The least of which is the burned down home.

I am in Florida. Legal system ...I am not a big fan. It's my Fathers Fault. I will tell you this my friends. Get your affairs in order. My Father did not . I was able to secure his removal from the Examiners Office to the funeral home today . It is an absolute nightmare. My Brother and I have been beating our heads against brick walls for two days. Reminded today of how fortunate I am, and how much God has blessed me with.

When Scott says get your affairs in order, he means go get legal documents that spell out what you want done to you and your spouce. If those papers are not there, then the state steps in and handles it to their benefit. You, the survivor, may end up paying them on top of all of it. This includes your medical wishes. If you don't, they could keep you alive on the end of a tube. Then, they make your children responsible for the bills. Estate planning, medical power of attourney, trust formation, living will, you need all of this or the family is literally thrown to the wolves. You need to find a lawyer who spends time in court and is up on the latest devilish angles the Gov't and other lawyers have done to set new legal rules. Putting it mildly, they want all your money and properties. If you end up in a hospital and don't have a medical will, they have to follow regulation. You don't get to choose what you want done to you. So, do it, go see a lawyer now or you will regret it. Another thing that happens is a family fight over what is left of the estate. If that pops up, then a answer is to hold a estate auction. The proceeds are then to be distributed equally to the survivors. If there is a particular thing they want to keep, then they bid on it and pay for it out of the proceeds. In other words, a fair fight! Next: did you know when your Grandpa or grandma, mother or father go into a nursing home or hospital, that medicare only pays for 100 days. Then the money comes from the sale of the car, house, checking acct., savings acct., stocks, bonds, until it's gone!!!!!!!!!!!! No bull! That's where estate planning happens. If you don't have all your life's work in a trust (irrevocable) or already in the kids or beneficiary's name, (for 7 years) they take it all. Then it goes to the state or medicaid. You become a ward of the state. Sad when the spouce is destitute and out on the street because no planning was done. They are out there waiting for you! Go see a lawyer real soon! Like now! What Oil said is correct. Not to mention the stress and pressure you put on your family. I guess some think that they will live forever. It also can be as bad as paperwork just to be buried. I will be working on mine, I assure you. Oddly enough there is a Haines Law Firm here in Mount Pleasant. Guess who will be handling my will.

IMNLHO, a will is a waist of money, Read oilleakers post, Irrevocable Trust is where you want to invest your time and money. My folks had both, the will was never taken out of the envelope, the trust is the most valuable thing you can do for your family. 1) Power of Attorney, 2)Health Care Directive,3) Affidavit of Identity and Survivorship, 4) Affidavit for collection of personal property. In my personal experience, this gave my sister and I the tools to handle the finances and health Issues our parents faced as their health declined, and avoids Probate after Death. This is what we will set up as well. Lee

Just what you both said. I worded it wrong . That's why I am speaking with an attorney soon about my own arrangements. Funny thing about wills. People can contest them!!! Hold everything up in court . What a bunch of BS. I found some really cool Schiller / Horstmeyer artifacts in the rubble. Some family papers and pictures. Letters that were written from Viet nam, as well as WW2 and Korea to my Grandmother.

I figure when I can't use or play with my creations, I'll gift to my relation what they expressed a desire for, and sell down. I dunno if any of you lot are lawyers by profession, but in researching Oily's irrevocable trust post I ran across this: www.forbes.com/sites/ashleaebeling/2013/06/05/how-to-kill-an-irrevocable-trust/Figures that somehow some greasy, sleazy, greedy and subhuman lawyer figured out a way to breech an "irrevocable trust". If I'm honest, this is precisely the reason I use the F-word, ya know the "non-Ford" one. There is no mistaking the word for something else, and no way around changing the literal definition which is what scumbag lawyers specialise in doing. In the company of lawyers, this word usually comes out in NOUN form, or in some derivation like "F-ing subhuman weasel", or "typical F-tard lawbreaker" or something more colourful and delivered with more "OOMPH" and a little hip-wiggle. When I work on MY papers, there is going to be much commentary as to exactly what my intention is, done so some "goitfaced, F-in spineless cheat F-in lawyer" can manipulate my words into something unintended. I understand if you kick me off the forum - I don't like me neither! ROR!

The greatest thing about the F word is that it can be used as any word type. Noun, pronoun, verb, adverb, adjective, etc. It's no wonder its become such a favorite for so many of us.
I started to read up on the irrevocable trust. Interesting.

Along with Oilleaker and Haines prompting to get your stuff in order now: We found out that my companies' employee benefits include estate planning/document generation services. While we were doing some volunteer work (lots of waiting around), My wife and I got all of our will, living will, and estate planning worked through. No cost, no lawyer. Might be something to ask about where you work. It was a 2014 goal for us and we got it done with just days to spare. It is one of those things that folks don't like to talk about and it is very easy to push the project out because it doesn't change your life day-to-day, but yeah it makes it a lot easier for loved ones to figure stuff out.

Detard! That's why I said go to a trial lawyer that is active and knows the latest cases. He then uses the right wording to combat the slimyer one. Oil (PS, mine currently is in a revocable trust. When ready, you call the lawyer who set it up and have it changed to irrevocable. Then it needs to be that description for 7 years)

I have retained a Lawyer. I like him because his last name is Kaiser...no shit. He talks like me, and makes me laugh. I feel good about it. He's right on top so far. It's going to be a long road however. Dad has been cremated, flying to see me soon. I will get him to Arlington Somehow.
